Recycled Content- Derogations and other clauses
Safety Clause
Derogations*
EC empowered to adopt delegated act to adjust set recycled content targets,
Article 7 does not apply to:
where justified by lack of availability or excessive prices of recycled plastics
• Immediate and outer packaging of medicinal products (for veterinary and
human use)
that can have adverse effects on human or animal health, security of food
• Contact-sensitive plastic packaging of medical devices (incl. in vitro diagnostics
devices), and devices destined for research use and investigation, of food
intended for infants and young children, of food for special medical purposes,
and packaging of drinks and food typically used for young children
• Compostable plastic packaging
supply or the environment.
Review Clause
By 12 February 2032, EC to review the implementation of the 2030 targets and
evaluate the feasibility of the targets set for 2040.
By 12 February 2032, EC to review the use of recycled packaging materials in
• Packaging used to transport dangerous goods
• Packaging of supplies, components, and immediate packaging components for
the manufacturing of medicinal products (for veterinary and human use)
• Food contact plastic packaging in case recycled content poses a threat to
human health and results in non-compliance with the general FCM Regulation
• To any plastic part representing less than 5% of the total weight of the whole
packaging
packaging other than plastic and assess the appropriateness of setting
targets for the use of recycled content in such other packaging.
Compliance
Compliance will have to be demonstrated by economic operators in technical
documentation as set out in Annex VII (Conformity assessment procedure).

*To be reviewed, by 1 January 2028, to assess the need for additional derogations from the 10% and 35% recycled content targets set for 2030 or for the revision of the above-mentioned derogations for specific plastic packaging.
