Extended producer responsibility
AUTHORISED REPRESENTATIVE - ARTICLE 45 (3)
“A producer shall appoint, by written mandate, an authorised
representative for the extended producer responsibility in each
Member State where the producer makes packaging or packaged
products available for the first time other than the Member State
where the producer is established.”
This means that every company or online seller that ships packaged goods
to a European Member State in which they do not have a branch must
have a representative for extended producer responsibility in each of these
countries.
Member States may also require producers from outside the EU to appoint
an authorised representative for extended producer responsibility when
making packaged products available on their territory for the first time.
